Below are details on the Weblium/Draftium Partnership Programs, please read carefully before applying.
1. Intro
1.1. These rules are applied to the partnership/affiliate programs of the next services:Weblium DIY, Weblium Studio, Weblium Weblium Agency White Label, Weblium White Label Builder, Draftium.
1.2. Be aware that each of our programs may have their own rules of participation. Please contact our manager in order to get full information about a specific program.
1.3. You're prohibited to place your personal promo codes on coupon websites without having confirmation from our partnership manager.
2. Definitions
2.1. "Partner" or "you" means any person or legal entity, which completed the signup process on our Website and became a participant of the Weblium Partnership Program. Participation in the Weblium Partnership Program is prohibited to individuals and entities who possess a voting or political interest in Weblium, including Weblium officers, directors, stockholders and employees of Weblium, and their immediate families.
2.2. Weblium Partnership Program is a revenue-sharing program, developed by Weblium that allows you, the Partner, to use marketing methods to promote our services and drive traffic to our website in order to be rewarded for generated sales.
2.3. "Commission" means the monetary compensation you receive, according to our rules, for participating in Weblium Partnership Program; the Commission consists of percent of your total sale amount.
3. Partner Rights
3.1. We grant you, subject to the limitations set forth below, a limited, non-exclusive, non-assignable, non-sublicensable, non-transferable, revocable right to: (i) demonstrate and promote the Weblium Services to your prospects and customers, and (ii) to provide End Users access to use the Weblium Services, in accordance with this Agreement and Weblium terms and conditions, specified on the Weblium site, provided that End Users agreed to Weblium terms and conditions, specified on the Weblium Website.
3.2. You may place banners or Reference Links within your newsletters, on Your Website, or within other web-related content.

4. Partners Obligations
4.1. You must provide your full legal name, a valid email address, a valid domain name of Your Website and all other information requested in order to complete the signup process on the Weblium Partnership Program. All information you provide in your profile must be truthful. You are solely responsible for all the information you provide in Your Account profile and on Your Website.
4.2. You will be solely responsible for the development, operation, and maintenance of Your Website and for all materials that appear on Your Website. You should ensure that materials posted on Your Website do not violate or infringe the rights of any Third Party (including, for example, copyrights, trademarks, privacy, or other personal or proprietary rights). You will be solely responsible for the accuracy, truthfulness, and appropriateness of materials posted on Your Website.
4.3. Partner warrants and guarantees on behalf of itself and its affiliates, subsidiaries, agents and subcontractors: (i) that all personal data, contained in the Leads (if any) or any other data or material, provided to Weblium according to this Agreement, were collected in accordance with all applicable laws, including but not limited to, applicable data protection laws;(ii) that the Partner is fully allowed to transfer personal data to Weblium and that the Partner received all necessary permissions so that Weblium could store and process such personal data, use it in marketing purposes and for offering its services.
5. Prohibited uses
We may stop your participation in our partnership program if we determine that your site/source of traffic doesn’t suit our requirements. We don’t accept sites that:
5.1. Promotes sexually explicit materials.
5.2. Promotes violence.
5.3. Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
5.4. Promotes illegal activities.
5.5. Incorporates any materials which infringe or assist others to infringe on any copyright, trademark or other intellectual property rights or to violate the law.
5.6. Includes "Weblium" or variations or misspellings of this word. Also, if the design of your site reminds Weblium official site and can be mixed up with our site.
5.7. It contains software downloads that potentially enable diversions of commission from other affiliates in our program. Redirect pages, domain forwarding, doorways are also prohibited.
5.8. We do not accept traffic from SPAM activities or from unsolicited commercial emails.
5.9. Use any kind of cookie stuffing.
5.10. Use traffic sources that are forbidden by a system or a specific program.
5.11. Use promo materials that don’t apply on the offer, including materials that referred to another offer or brand to attract traffic;
5.12. Hide or modify a referer.
5.13. Mislead users by false facts about the offer to attract traffic.
5.14. Use sites with a design or domain name that is similar to Weblium official website or have some similarities with it, including cybersquatting.
5.15. Simulates conversions in any way, including:● make conversions yourself;● make conversions by other users as the result of a request, reward, cheating or misleading;● initiate the automatic actions of users with the help of scripts, bots, and any other means.
6. Commission
6.1. To be eligible to earn a Commission, the End User must purchase Weblium Subscription within the stated Cookie life period of coming to Weblium Website through the Reference Link from Your Website, email, or other communications or using your personal promo code. If a sale occurs after the Cookie life period expires and the End User has not returned through the Reference Link and purchased the Weblium Subscription, then no Commission shall occur.
6.2. Your Commission starts from 20% (twenty percent) of the total sale amount unless otherwise stated in conditions of our separate programs. In some cases or specific conditions, the partner’s commission can be increased to 70%.
6.3. Commissions earned through fraudulent, illegal, or overly aggressive, questionable sales or marketing methods will be voided. Fraudulent activities will also result in immediate account cancelation.
7. Weblium has rights
7.1. Require the Partner to provide detailed information about the sources of traffic in case of suspicion of a simulation of conversions or other illegal actions.7.2. Prevent the Partner from working with a specific Weblium offer.7.3. Block Partners (without the right to payment) for violating the rules of the system/our terms without explanation, if there is evidence.7.4. Change terms and conditions of this agreement without a separate written notice to partners.7.5. Other rights that were mentioned in this agreement or our Terms of Use.
8. Indemnity
You agree to defend, indemnify and hold harmless Weblium and its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to Weblium Website and participation in Weblium Partnership Program; (b) your violation of any term of this Agreement or applicable law;(c) your violation of any Third Party right, including without limitation any copyright, property, or privacy rights.
This defense and indemnification obligation will survive the termination of this Agreement and your use of Weblium Services and participation in the Weblium Partnership Program. 9. Authority
Each party represents and warrants to the other party as to itself that the person executing this Agreement is authorized to do so on such party's behalf. If you are individual, you represent and warrant that you were at least 18 years of age on the effective date of this agreement. If you are under 18, please do not attempt to participate in Weblium Partnership Program or send any information about yourself to us, including your name, address, telephone number, or email address. If we learn that we have collected personal information from anyone under age 18 without verification of parental consent, we will delete that information as quickly as possible.
10. Disclaimer of warranties
Except where prohibited by law, Weblium partnership program and Weblim services are provided "as-is" and "as available" and we expressly disclaim any warranties and conditions of any kind, whether express or implied, including the warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement. We make no warranty that the Weblium Partnership program or the Weblium services (a) will meet your requirements and/or expectations; (b) will be available on an uninterrupted, timely, secure, or error-free basis; or (c) will be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe.
We further make no warranties or representations regarding the accuracy or completeness of the content on any sites linked to the Weblium website.
11. Limitation of liabilities
11.1. In no event shall Weblium, its officers, directors, employees, or agents, be liable to you or to any Third Party for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever arising from or related to either this Agreement or use of Weblium Services or participation in Weblium Partnership Program. Our liability to you for any damages arising from or related to this Agreement, will at all times be limited to the greater of $50 (fifty USD). The existence of more than one claim will not enlarge this limit. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
11.2. The Affiliate accepts that the operation of the Weblium Partnership Program, Reference Links or Weblium Services may not be completely free of interruption, errors or omissions and Weblium is not liable for the consequences of any interruptions or errors in the performance or content of the Weblium Services or Reference Links.
11.3. Weblium does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by the Third Party through Weblium Website, hyperlinked website or Reference Links or featured in any banner or other advertising, and Weblium will not be a party to or in any way be responsible for monitoring any transaction between you and Third Party providers of products or services.
11.4. We make no representations that Weblium Partnership Program or Weblium services are appropriate or available for use in all locations. Those who access or use Weblium Website or participate in Weblium Partnership Program from jurisdictions prohibiting such use, do so at their own volition and are responsible for compliance with local law.
11.5. We reserve the right to use Third-Party service providers in the provision of all or part of the Agreement including, but not limited to, hosting providers, payment processing services, information and communication services, analytics services, internet advertising platforms, advertising service providers and platforms. Where any of the aforementioned services are provided by third parties, the Partner may be subject to such Third Party's terms and conditions. We accept no responsibility for services provided by any Third Party.
12. Miscellaneous
12.1. Force Majeure. We shall not be liable for failing or delaying performance of our obligations resulting from any condition beyond our reasonable control, including but not limited to, use of third parties' equipment or services, communications failure, governmental action, war, acts of terrorism, earthquake, fire, flood or other acts of God, labor conditions, power failures, and Internet disturbances.
12.2. Relationships. You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representatives, or employment relationship between you and us. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on Your Website or otherwise, that reasonably contradict anything in this Agreement.
12.3. Tax Status and Obligations. Weblium is not obligated to and shall not provide you with tax and/or legal advice. Weblium undertakes no duty to investigate or research your tax status and/or obligations, and such research and investigation are solely your responsibility. You are obligated to independently assess and comply with all relevant tax and legal requirements, and you are solely responsible for your own sales tax collection, reporting and any other obligation arising from Commission income.
12.4. Privacy. Participation in Weblium Partnership Program is also governed by our Privacy Policy, the provisions of which are adopted herein by reference so when we refer to this Agreement we also refer to the Privacy Policy.
12.5. Marketing. You agree that Weblium may identify you as a Weblium Partner and may use your name and/or logo solely for such purpose in its marketing materials.
12.6. Amendment. Weblium has the right to change, modify or amend ("Change") these Weblium Partnership Program Terms, in whole or in part, by posting a revised Weblium Partnership Program Terms on Weblium Website. Your continued participation in the Weblium Partnership Program after the date of such Change shall be deemed your acceptance of the revised Weblium Partnership Program Term.
12.7. Electronic Notices. You agree to receive communications from us in an electronic form. Electronic notices will be delivered to your email address, which you used for registration purposes, as it may be subsequently changed by you by written notice to us. All communications in electronic format will be considered to be "in writing" and to have been received on the day that we send them. We reserve the right, but assume no obligation, to provide communications in paper format.
